Bildirildi\u011fi kadar\u0131yla, Twitter hi\u00e7bir zaman ba\u015fka bir politikac\u0131n\u0131n tweet\u2019ine b\u00f6yle bir etiket koymam\u0131\u015f gibi g\u00f6r\u00fcn\u00fcyor. Ayr\u0131ca \u00c7in h\u00fck\u00fcmet yetkililerinin, platformlar\u0131n\u0131 COVID-19 salg\u0131n\u0131n\u0131n k\u00f6kenleriyle ilgili yanl\u0131\u015f bilgileri yaymak ve Hong Kong\u2019daki demokrasi yanl\u0131s\u0131 protestolar\u0131 baltalamak i\u00e7in kullanmalar\u0131na izin vererek, yurtd\u0131\u015f\u0131ndaki \u00c7in propagandas\u0131n\u0131 da g\u00fc\u00e7lendirdiler.<br>Bir millet olarak, t\u00fcm Amerikal\u0131lar\u0131n kendilerini dile getirebildi\u011fi ve getirmesi gerekti\u011fi bug\u00fcn\u00fcn dijital ileti\u015fim ortam\u0131n\u0131n sahip oldu\u011fu \u00e7e\u015fitli bak\u0131\u015f a\u00e7\u0131lar\u0131n\u0131 korumal\u0131 ve te\u015fvik etmeliyiz. \u00c7evrimi\u00e7i platformlar\u0131n \u015feffaf ve hesap verebilir olmas\u0131n\u0131 istemeli ve Amerikan s\u00f6ylemi ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc ve aleniyetini koruma ve muhafaza etmeye y\u00f6nelik standart ve ara\u00e7lar\u0131n\u0131 te\u015fvik etmeliyiz.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>B\u00f6l\u00fcm 2: \u00c7evrimi\u00e7i Sans\u00fcre Kar\u015f\u0131 Korumalar<\/strong><br>(a) Birle\u015fik Devletler politikas\u0131, internet ortam\u0131nda \u00f6zg\u00fcr ve aleni tart\u0131\u015fmay\u0131 te\u015fvik eden temel kurallar\u0131 desteklemektir. Bu tart\u0131\u015fmalar\u0131n y\u00f6netilmesindeki temel kurallar\u0131n aras\u0131nda \u0130leti\u015fim Ahlak\u0131 Kanunu (Madde 230 (c) ) 47 U.S.C. 230 (c)\u2019 de ortaya konan sorumluluktan muafiyet dikkat \u00e7ekmektedir. Muafiyet metin ve amac\u0131n\u0131n \u00f6tesine ge\u00e7erek kullan\u0131c\u0131lara \u00f6zg\u00fcr ve aleni bir ifade ortam\u0131 sa\u011flama iddias\u0131nda bulunup asl\u0131nda g\u00fc\u00e7lerini etkili ileti\u015fim ara\u00e7lar\u0131yla aldat\u0131c\u0131 ve uydurma eylemlere kalk\u0131\u015fmak i\u00e7in kullanan, belirli bak\u0131\u015f a\u00e7\u0131lar\u0131n\u0131 sans\u00fcrleyerek \u00f6zg\u00fcr ve aleni tart\u0131\u015fmay\u0131 bask\u0131layanlar\u0131 korumamal\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Madde 230 (c), \u00e7evrimi\u00e7i platform ba\u015fkalar\u0131 taraf\u0131ndan y\u00fcklenen bir tak\u0131m i\u00e7eriklere eri\u015fimi k\u0131s\u0131tlad\u0131\u011f\u0131 takdirde hakaret gibi haks\u0131z fiiller bak\u0131m\u0131ndan sitesinde payla\u015f\u0131lan t\u00fcm i\u00e7eriklerin \u201cyay\u0131nc\u0131s\u0131\u201d haline gelece\u011fini kabul eden mahkeme kararlar\u0131n\u0131n [getirdi\u011fi sorunu] \u00e7\u00f6zmek i\u00e7in dizayn edilmi\u015ftir. Kongre, \u00f6zellikle re\u015fit olmayanlar\u0131 zararl\u0131 i\u00e7eriklerden korumaya \u00e7al\u0131\u015fan \u00e7evrimi\u00e7i platformlara koruma sa\u011flamak istemi\u015f ve bu sa\u011flay\u0131c\u0131lar\u0131n zararl\u0131 materyali dola\u015f\u0131mdan kald\u0131rmaktan cayd\u0131r\u0131lmamas\u0131n\u0131 temin etmeyi ama\u00e7lam\u0131\u015ft\u0131r. Bu h\u00fck\u00fcm, ayn\u0131 zamanda, Kongrenin, internetin \u201csiyasi s\u00f6ylemlerin hakiki \u00e7e\u015fitlili\u011fi i\u00e7in bir mecra\u201d oldu\u011fu konusundaki a\u00e7\u0131k g\u00f6r\u00fc\u015f\u00fcn\u00fc devam ettirmeyi ama\u00e7lam\u0131\u015ft\u0131r 47 U.S.C. 230(a)(3). Birle\u015fik Devletler\u2019in politikas\u0131, kanunun izin verdi\u011fi azami \u00f6l\u00e7\u00fcde, i\u015fbu h\u00fckm\u00fcn \u2013 naho\u015f i\u00e7erikleri \u201ciyi niyetli\u201d olarak kald\u0131rmaktan ziyade- \u00f6zellikle kendileri taraf\u0131ndan uygun bulunmayan g\u00f6r\u00fc\u015fleri bast\u0131rmak amac\u0131yla (genellikle de hizmet kullan\u0131m \u015fartlar\u0131na ayk\u0131r\u0131 olarak) aldat\u0131c\u0131 ve uydurma uygulamalara giri\u015fen \u00e7evrimi\u00e7i platformlara sorumluluk korumas\u0131 sa\u011flamak i\u00e7in tahrif edilmemesini temindir. 230\u2019ncu madde tart\u0131\u015fmaya a\u00e7\u0131k mecralar\u0131 te\u015fvik etme iddias\u0131 ad\u0131 alt\u0131nda birka\u00e7 \u015firketin milli s\u00f6ylemimiz i\u00e7in hayati \u00f6neme sahip kav\u015faklar\u0131 kontrol eden devasa [kurulu\u015flara] d\u00f6n\u00fc\u015fmesine m\u00fcsaade etmek ve bu dev kurulu\u015flar g\u00fc\u00e7lerini ho\u015flar\u0131na gitmeyen g\u00f6r\u00fc\u015fleri susturmak ve i\u00e7erikleri sans\u00fcrlemek i\u00e7in kulland\u0131klar\u0131nda onlara genel muafiyet sa\u011flamak amac\u0131yla tasarlanmam\u0131\u015ft\u0131r. Birle\u015fik Devletler\u2019in politikas\u0131, bu t\u00fcr bir sa\u011flay\u0131c\u0131n\u0131n (c)(2)(A) bendinde belirtilen s\u0131n\u0131rl\u0131 sorumluluk korumas\u0131n\u0131 tamamen kaybetmesi ve \u00e7evrimi\u00e7i bir sa\u011flay\u0131c\u0131 olarak de\u011fil de geleneksel bir edit\u00f6r ve yay\u0131nc\u0131 gibi sorumlulu\u011fa maruz kalmas\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>(b) Bu b\u00f6l\u00fcm\u00fcn alt b\u00f6l\u00fcm\u00fc a\u2019da tarif olunan politikay\u0131 s\u00fcrd\u00fcrmek i\u00e7in t\u00fcm h\u00fck\u00fcmet daire ve organlar\u0131; madde 230(c)\u2019yi uygulamalar\u0131n\u0131n, bu b\u00f6l\u00fcm\u00fcn dar amac\u0131n\u0131 uygun bir \u015fekilde yans\u0131tt\u0131\u011f\u0131ndan emin olmal\u0131 ve bunun i\u00e7in uygun ad\u0131mlar\u0131 atmal\u0131d\u0131rlar. Bunun yan\u0131 s\u0131ra, bu kararnamenin [\u00e7\u0131k\u0131\u015f] tarihinden itibaren 60 g\u00fcn i\u00e7erisinde Ticaret Bakan\u0131 (Bakan); Adalet Bakan\u0131na dan\u0131\u015farak ve Milli Telekom\u00fcnikasyon ve Bilgi \u0130daresi (NTIA) arac\u0131l\u0131\u011f\u0131yla hareket ederek Federal \u0130leti\u015fim Komisyonuna (FCC), FCC\u2019nin acilen a\u015fa\u011f\u0131daki hususlar\u0131 vuzuha kavu\u015fturmak y\u00f6nelik d\u00fczenleme \u00f6nermesi i\u00e7in kanun yap\u0131m\u0131 dilek\u00e7esi sunmal\u0131d\u0131r:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>(i) 230\u2019ncu maddenin (c)(1) ve (c)(2) bentleri aras\u0131ndaki ili\u015fki. Hususen de (c)(2)(a) bendi taraf\u0131ndan \u00f6zellikle korunmayan bir \u015fekilde bir i\u00e7eri\u011fe eri\u015fimi k\u0131s\u0131tlayan interaktif bilgisayar hizmeti sa\u011flay\u0131c\u0131s\u0131n\u0131n, (c)(1) bendinin sa\u011flad\u0131\u011f\u0131 korumay\u0131 \u00f6ne s\u00fcremeyece\u011fi \u015fartlar\u0131 vuzuha kavu\u015fturmas\u0131 ve belirlemesi. (c)(1) bendi sadece sa\u011flay\u0131c\u0131ya \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin i\u00e7eriklerini eri\u015filebilir k\u0131ld\u0131\u011f\u0131 i\u00e7in yay\u0131nc\u0131 veya konu\u015fmac\u0131 olarak muamele edilmeyece\u011fini ifade etmekte ve sa\u011flay\u0131c\u0131n\u0131n kendi edit\u00f6ryal kararlar\u0131ndan sorumlulu\u011funa de\u011finmemektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>(ii) Bir materyale eri\u015fim veya onun kullan\u0131labilirli\u011fini k\u0131s\u0131tlay\u0131c\u0131 bir ad\u0131m\u0131n 230\u2019ncu madde (c)(2)(a) bendinde kastedildi\u011fi manada \u201ciyi niyetle at\u0131lmad\u0131\u011f\u0131\u201d \u015fartlar\u0131. \u00d6zellikle de bu ad\u0131mlar\u0131n a\u015fa\u011f\u0131daki \u015fekillerde ise \u201ciyi niyetle at\u0131l\u0131p at\u0131lamayaca\u011f\u0131n\u0131\u201d:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>(A) aldat\u0131c\u0131, uydurma ya da sa\u011flay\u0131c\u0131n\u0131n kullan\u0131m \u015fartlar\u0131na ayk\u0131r\u0131; ya da<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>(B) uygun bir bildirim, makul bir a\u00e7\u0131klama yap\u0131lmaks\u0131z\u0131n ya da dinlenmesi i\u00e7in makul bir se\u00e7enek sunulmaks\u0131z\u0131n at\u0131lm\u0131\u015f; ve<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>(iii) bu b\u00f6l\u00fcm\u00fcn (a) alt b\u00f6l\u00fcm\u00fcnde tarif olunan politikay\u0131 s\u00fcrd\u00fcrmek i\u00e7in NTIA\u2019n\u0131n uygun olabilece\u011fi sonucuna vard\u0131\u011f\u0131 di\u011fer d\u00fczenleme \u00f6nerileri.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><strong>B\u00f6l\u00fcm 3: Federal Vergilerle \u00d6zg\u00fcr \u0130fadeyi K\u0131s\u0131tlayan \u00c7evrimi\u00e7i Platformlar\u0131 Finanse Edilmesini Engellemek<\/strong><br>(a) T\u00fcm h\u00fck\u00fcmet daire ve organlar\u0131n\u0131n (organ) m\u00fcd\u00fcrleri kendi organlar\u0131n\u0131n \u00e7evrimi\u00e7i platformlarda reklam ve pazarlama i\u00e7in yapt\u0131\u011f\u0131 federal harcamas\u0131n\u0131 g\u00f6zden ge\u00e7irecektir.
